All companies, regardless of their size, the industry in which they operate or the geographic scope of their business, are subject to document retention requirements. This is particularly the case in regulated industries, such as financial services. The statistics are startling. According to a 2009 Iron Mountain Compliance Benchmark Report:
- Only 28% of the companies surveyed had a company- wide records retention program in place.
- The remaining 72% had either no records management program at all, or relied on individuals and departments to handle their own records retention.
- Over 95% of all records are electronically stored information, but only 13% of all companies surveyed manage electronic records in compliance with an existing records retention schedule.
- Sixty-seven percent of the companies surveyed have no or few written procedures for notifying employees of a legal hold and prevent the destruction of records in the event the company faces a litigation or government investigation.

Thomas M. Mueller is a partner in the law firm of Morrison Foerester and co-head of the firm’s Electronic Discovery Task Force. Mr. Mueller counsels clients on records retention and records management issues, including processes and procedures to respond to electronic discovery requests. Mr. Mueller has served as a panelist for CLE seminars and has published articles on topics of e-discovery and information management. In addition, he is a member of The Sedona Conference Working Group 6 on International Electronic Information Management, Discovery and Disclosure and the ICC Commission on Arbitration Task Force “Production of Electronic Documents in Arbitration.”
Mr. Mueller is a member of the New York bar and holds the AV (highest) Peer Review Rating from LexisNexis Martindale-Hubbell and is listed in Who’s Who in American Law and recognized as a leading attorney in the area of antitrust by New York Super Lawyers and Best Lawyers in America.
Mr. Mueller received his B.A., magna cum laude, from Lehigh University in 1983, and his J.D., cum laude, from the University of Michigan Law School in 1986.
